TERMS AND CONDITIONS FOR CHIARO AI

Effective Date: August 22, 2025

1. ACCEPTANCE OF TERMS

By downloading, installing, or using Chiaro AI ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

The App is operated by Anatoly Terentyev, an individual sole proprietor registered in the Republic of Armenia ("we," "us," or "our").

2. DESCRIPTION OF SERVICE

Chiaro AI is an AI-powered travel companion application that provides:

• Conversational AI travel guidance using advanced language models
• Photo analysis for landmark identification and text translation
• Location-based recommendations when permission is granted
• Voice interaction capabilities
• Local storage of conversation history
• Travel planning assistance across seven specialized categories

3. USER ELIGIBILITY

You must be at least 13 years of age to use this App. If you are between 13 and 18 years old, you must have parental or guardian consent. By using the App, you represent that you meet these eligibility requirements.

4. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, adapt, or hack the App
• Reverse engineer or attempt to extract the source code
• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction

5. PRIVACY AND DATA COLLECTION

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy. By using the App, you consent to:

• Local storage of conversations on your device using Core Data
• Processing of photos through AI (images are analyzed but not permanently stored)
• Optional location services for contextual recommendations
• Encrypted API communications for AI responses

We do not sell, rent, or share your personal data with third parties for marketing purposes.

6. USER CONTENT AND CONDUCT

You retain ownership of any content you provide to the App (photos, queries, etc.). By submitting content, you grant us a limited license to process this content solely for providing App services.

You agree not to:

• Use the App for any unlawful purpose
• Submit content that violates intellectual property rights
• Attempt to interfere with the App's functionality
• Use the App to harass, abuse, or harm others

7. AI-GENERATED CONTENT DISCLAIMER

The App uses artificial intelligence to generate travel recommendations and information. While we strive for accuracy:

• AI responses are provided "as is" without guarantees of accuracy
• Recommendations should be independently verified
• We are not responsible for decisions made based on AI suggestions
• Local laws, customs, and safety conditions should always be considered

8. LOCATION SERVICES

The App may request access to your device's location. You may enable or disable location services at any time through your device settings. Location data is used solely for providing relevant travel recommendations.

9. INTELLECTUAL PROPERTY

All intellectual property rights in the App, including but not limited to the design, artwork, functionality, and AI integration, are owned by us or our licensors. The Chiaro AI name, logo, and all related marks are our proprietary marks.

10. THIRD-PARTY SERVICES

The App integrates with third-party AI services (Claude API) for core functionality. We are not responsible for third-party service interruptions or changes that may affect App performance.

11. DISCLAIMERS AND LIMITATIONS OF LIABILITY

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY ARMENIAN LAW:

• We disclaim all warranties, express or implied
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the App
• We do not guarantee uninterrupted or error-free operation

12. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Updated Terms will be posted in the App with a new effective date. Continued use after changes constitutes acceptance of modified Terms.

14. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms. Upon termination, your license to use the App ceases immediately.

15. GOVERNING LAW

These Terms are governed by the laws of the Republic of Armenia. Any disputes shall be resolved in the courts of Yerevan, Armenia.

16. APPLE-SPECIFIC TERMS

For iOS users:

• These Terms are between you and us only, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is a third-party beneficiary of these Terms with the right to enforce them

17. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
